Continued validity of previously issued residence permits

Temporary residence permits and permanent residence permits issued before the NAG (Residency and Leave to Remain Act) came into force (i.e., prior to 1 January 2006) remain valid according to the provisions of the Durchführungsverordnung (Implementing Regulation ) for the Act until such time as they expire, and will continue to be treated as valid resicence permits according to the NAG and/or as authorisation to remain in Austria under the FPG (Foreigners Policing Act).

Before the NAG came into force, residence permits were entered into passports as stamps. Since the Act entered into force, residence permits have been issued as separate residency cards, in a credit-card sized format. If your residence permit is currently stamped in your passport, your residence permit will be re-issued separately in credit-card format when you apply for a new passport.
